My wife will be flying to America for the Permit

Which consulate will she be applying to?

NY has a bit different procedure for appointments that LA or Chicago. Does she have friends near any of those cities?

No, he's Irish. I know there is a precendent for being able to apply for a Family Permit for the UK even if you're British, if you have been exercising your treaty rights as a family elsewhere in the EU. (try googling the surinder singh case)

The thing I'm wondering about though, is that if the embassy only looks at the stamps in the non-EU spouses passport as proof of residing in another EU country, or if they would accept any documentation that a decision on outstanding applications was still being made, etc. Hopefully one of the experts would know.

It's too bad you all can't just tell the embassy that the irish immigration system is one giant clusterf**k!!!!!!!

hi, can somebody give me a bit of advise on how to apply for british family permit n how long they take to process it.....any posibility of rejection? what documentation they require???? thanks a million!

File form VAF2 with the British embassy and then wait. Passports and marriage certs are needed. Further details at....

Family Permit is applied for using form VAF1. If I remember correctly, VAF2 is the UK spousal visa form.

Yeah he had been working in the UK for about 2 years.

for the EEA family permit, you will need to fill the VAF1 form.
-marriage certificat
-photo 1
-both passeports
_GNIB card
-for the british citizen:a recent irish bank statement, showing at least 3months of transactions.
-letter from irish employer,outlining length of employement.
-recent payslips(3 months worth).
-a signed declaration outlining how long you have known your spouse,how long you intend to stay in the UK together,how long you have been living in ireland,and evidence of where you will live together in the UK.
-evidence that you are living together in ireland(eg a recent utility bill/tenancy agreement in joint names).
and it takes about a week

Birdy, they misinformed you.

"What will my non-EEA family members need to make an application?

They will need make their application online or fill in the following visa application form:

pdf Application form VAF1 - Non-Settlement (PDF, 165K)"

You can download the form from that link and it clearly states on the form that it's for family visitor, and EEA family permit.

Stmani, I applied for mine in the United States and received it same day.

Nothing surprises me any more and now they are saying i cannot apply for it if she is in the states and i am in england and i have to apply for the spousal visa.

I wish i could call the embassy but they direct me to the Premium rate fone number on the website Grrrrrr

She will be going to chicago and i think she can even do it all online althugh by the looks of things she has to be here with m to apply for the EEA family permit and im not waiting another 13 weeks

Don't bother calling the premium rate number; a number of people have received incorrect advice, and paid a pretty fortune to boot.

Try contacting the Law Centre in Northern Ireland. They have an immigration helpline and they were who I contacted with my own issues a while back and I found them to be really helpful. Until I spoke with them I didn't even know about the family permit and all, and the woman I spoke with was really good at breaking it down for me.

yeah we are in a pretty Sh@tty situation we cant afford to wait any longer so the Wife has to apply for something in the states flights 600â‚¬ approx then i have t take all our stuff in my car to england 250â‚¬ approx ferry and fuel. if we have to apply for the visa thats another 775â‚¬ the family permit was a ray of hope. If you have that number for the north people that would be great.

All applications for Family Permit in Dublin are done on-line now.
My wife was issued with the Family Permit in no time.
I`ve sent documents on thursday by registered post and got them back following wednesday.All in all 3 working days.
Mind you, she has one year Irish residence.
