Vary an application - 10 years based ILR

Vary an application - 10 years based ILR

Dear all,

My friend has applied for 10 years based long residence ILR. He has applied on 05/08/13. His first entry was on 20/09/2003, but because his leave was going to expire early so he applied about 45 days early before his 10 years are completed.now during initial process he has covered the extra 17 days, someone has advised him to vary the application with same 10 years based ilr application so that his application will become in legal frame time. Is this possible, can be vary his application with same type of application ?

He may very well be able to do so, provided this is considered as varying.

Essentially it will be a duplicated application as opposed to a varied application.

If he satisfies the requirements for ILR on the date of the decision, then he may also be okay.

Did your friend have already done his biometrics?

If he applied 05/08/13 on Set (LR) some one suggested him to apply again on Set (LR)?

Ideally he should have applied extension on some other grounds and then vary it on Set (LR).

I have a same situation, it would be great to keep in touch and update here for any possible outcome.

This means a valid variation will look like a new application. You must check CID to see if an earlier application exists. This will tell you whether the specified form is a variation of an existing application.

The application date remains the date of the original application and not the date of the variation. You will need to consider this when deciding if the applicant benefits from section 3C leave and determining the applicant’s appeal rights.
