hello,this is my problem ,im on disability benefit because of a long term illness.im a uk citezen from birth ,i married my wife on new years eve 2011.she is from moldova ,a non eu citezen .....i would like to know if any one knows how much money we need to have for a successful spouse visa application .........im exempt from the financial requirement part and we have all the other requirements needed ...its the finance part which is the problem ...we appplied just after we got married ..were refused because we didnt have enough money ,that was the only thing it was refused on......now the rules have changed yes?.......I WOULD BE VERY GRATEFUL IF SOMEONE COULD TELL ME HOW THIS NEW EXEMPTION PART ACTUALLY AFFECTS THE APPLICATION ....WE DONT WANT TO THROW AWAY ANOTHER £1000 AND GET REFUSED....PLEASE ADVICE PLEASE PLEASE PLEASE ..........

employment and support allowance-£181.99 weekly
disability living allowance-middle rate £53 lower rate £21 weekly
housing benefit-£63.99 weekly
council tax benefit-£74.41 weekly.
ive about £1000 savings.....

Income Support amount for a couple = £112.55 per week

Income = £181.99 + £53 + £21 + £63.99 = £319.98

Tariff income from savings = £1000 / 130 = £7.69 per week

Total income = £319.98 + £7.69 = £327.67

Rent = £63.99

Total Income – Rent = £327.67 – £63.99 = £263.68

£263.68 exceeds the income support applicable amount; therefore, you can adequately maintain yourselves and subject to suitable accommodation should be ok.

Remember that your ESA will reduce when your partner moves in; you will likely lose the Severe Disability Premium (around £55 per week less ESA).

You need to set your finances out as above on your application and if your income was the same last time, you should have disputed the decision.

If you don’t show the calculations then they sometimes refuse due to their ignorance.

Not really, if you set the calculation out clearly and include reference to Annex F and the case of Ahmed [benefits; proof of receipt; evidence] Bangladesh [2013] UKUT 84 [IAC] you should be ok. Also get a letter from your landlord saying it is ok for your partner to move in with you. Explain that s(he) will also be you carer (I assume so).

Part 3 of Appendix 2 is quite straight forward. However, I shall complete you a letter to add to your application. I shall post it on here at some point today. You shall be ticking Yes to question 3.1.

As the sponsor receives Disability Living Allowance (Middles Rate Care (MRC) and Lower Rate Mobility (LRM)) I am exempt from the financial requirement and therefore I am only required to adequately maintain and accommodate ourselves.

Following the Upper Tribunal case of Ahmed [benefits; proof of receipt; evidence] Bangladesh [2013] UKUT 84 [IAC] and the Immigration directorate instructions Chapter 8, Section FM 1.7A – Family – Maintenance (click) (include a copy) at page 3, paragraph 5.2 , staff considering an application for entry clearance, leave to remain, further leave to remain or indefinite leave to remain must demonstrate calculations detailing the actual financial position of the applicant/sponsor in all cases that fall for refusal using the following formula:

A – B ≥ C

A minus B is greater than or equal to C.

Where:

A is the projected income (after deduction of income tax and national insurance contributions);

B is what needs to be spent on accommodation; and

C is the amount of Income Support an equivalent British family of that size can receive.

For the purpose of income, benefit income can be used as income as per the Immigration directorate instructions Chapter 8, Section FM 1.7A – Family – Maintenance at page 2, paragraph 5.1(a). No benefit income is said to be excluded in the Immigration directorate instructions. I have calculated all figures as weekly as per the benefit entitlement letters (included). For C, the income support applicable amounts for my family unit, I have used the latest April 2013 income support rates as per the DWP figures (included).

Therefore,

A, income is:

Employment and Support Allowance = £181.99
Disability Living Allowance (MRC & LRM) = £74.00
Housing Benefit = £63.99

Total income = £319.98 per week

B, accommodation costs:

Rent = £63.99 per week

Total accommodation costs = £63.99 per week

C, income support applicable amount:

An amount for a couple = £112.55 per week

The total income support applicable amount for my family unit is £112.55 per week

A at £319.98 – B at £63.99 = £255.99

As £255.99 is greater than C at £112.55 I satisfy the requirements as per Ahmed [benefits; proof of receipt; evidence] Bangladesh [2013] UKUT 84 [IAC] and the Immigration directorate instructions Chapter 8, Section FM 1.7A – Family – Maintenance (include a copy) at page 3, paragraph 5.2. Therefore, my application should be granted.

Furthermore, I have savings of £1000 which would be an additional tariff income of:

£1000 divided by visa duration of 130 weeks (2.5 years) = £7.69 per week

I have supplied enough evidence, and explained the case clearly to show that we satisfy the adequate maintenance and accommodation requirement. Thus the application should be granted immediately.

hi,i just got an email from the ukba website stating Changes to the Knowledge of language and life in the UK requirement for
settlement and naturalisation....my wife got her IELTS ENGLISH CERTIFICATE on the 20th april 2012 ,we plan to apply in January 2014 ,is this certificate still valid ?or does she have to get this new certificate ?

The changes relate to settlement and naturalisation applications. For a spouse visa the A1 requirement is still effective.

hi,my wife just told me her passport was stamped when her visa was refused ....is there anything we can do about that? and will it affect the new visa application?
