Hi -
I am outside the UK and applied for a Sales Manager Job in UK. The Essential knowledge and skills required by the company are exactly meeting my experience. I went through several interview stages and finally I was accepted by the MD of the company. Both of us agreed on the contract terms (financially).
I was told we have to wait till the validity of the posting vacancy Finnish and then they can apply for a sponsorship form the UKBA.
My question now, does the UKBA have the right to accept or reject the request from the company to sponsor a foreigner?

Provided the company has a cat. A sponsor licence and through carrying out the resident labour market test found no settled worker to fill the post they have to apply to the Home Office for a restricted CoS for you. There is a monthly quota for restricted CoSs which are allocated on the 11th of each month for applications received by the 5th.

Hi – Thanks for answering me. Yes, the company has a sponsor license and accordingly to their MD he confirmed that no settled worker filled the post except me and the company decided to sponsor me under Tier 2 General Licence.
The company Put me in contact with their lawyer and both of them advised we have to wait till the validity of the posting vacancy Finnish.
Does your post mean that the Home Office has no right to reject any application and it’s just based on a monthly quota ? and what is the CoSs you are referring to?

Thanks - I can read that for the year 6 April 2013 to 5 April 2014, there are a limited number of restricted certificates available each month which is equal to 20,700 for the year.
What would be the case if my company applied for a Cos (certificate of sponsorship) and already the UKBA exceeded the number offering CoSs for the month?

According to the UKBA website, they haven't filled each monthly quota. My company is doing the same for me so I'm in the same boat as you - although I missed the cut off for September by only a few days as the RLMT didn't finish in time

Not yet - the RLMT finished Sept 9 so we missed the Sept 5 cut off for the allocations for the 11th. I've sent an email to HR at my new company asking what they need from me but that would have been late afternoon Friday UK time so I haven't heard back. My company is opting for the Oct 11 allocations (so Oct 5 cut-off).

I see.....Does that mean if my company finished the RLMS October 12, we will miss October? and we have to apply for Nov 11 allocations (so Nov 5 cut-off and we have to apply before Nov 5). correct?

That is correct. This is for restricted CoS's which is what your company would more than likely be applying for. The UKBA will consider issuing a CoS outside of their allocation date but only in exceptional circumstances

Just a question, My company is expecting to apply for the COS before 5th November.
Does that mean we will get answers by 11th November? Do i understand it correctly?

as far as I know, they have. My boss said yesterday that all the paperwork is in order so I can only assume that means everything is a-ok.

It's not stated anywhere and I'm not sure it matters - my company had already interviewed quite a number of people for my job prior to even being able to meet me for an interview. Has your company applied for your CoS yet?? My application just went through the other day for the Nov 5 deadline. What an ordeal this is!!

Hi i got the UK NARIC confirmation that my degree is equivalent to the the english degree. in regards to the english request, you have to get a document form you university confirming that all subjects were taught in English...
