Administrative Review OR Re-Apply( Which is best option)

Administrative Review OR Re-Apply( Which is best option)

Dear Friends,

My visa application has been refused yesterday. I applied for tier1 Entrepreneur visa with my team partner and the reasons for refusal are :

1) Deceleration of funds ( Money is in joint account account in uk bank) so do we need the deceleration of the money from team partner?? As we both attend the interview as well..??

2) i was in uk since 2009-2013 as student and i left the country to apply for tier 1 entrepreneur visa in 2013 march before completing my study ( they refuse by saying why didn't i extend my visa in 2013 and complete my study) is this the strong reasons to refuse the visa.?? as i clearly told them in interview that i was interested in doing my own business and want to start from beginning so i left uk.

3) proof of the funds( The funds is in uk bank account for more then 2 years and still they wants the proof of funds ) and also i submit few proof but most of them i don't have any more because its a long time ago.

there is a administrative review option....

So Senior members what do u think should i do..?? should i re-apply again or should i do administrative review...??

I dont have any sort of idea .....I need help...!!!!!!!

An administrative review is designed to identify them the error they have made which you think or sure that your facts and evidence have not been properly taken into consideration and want them to reconsider decision on your application in light of the facts and evidence you have put in administrative review.However,a fresh application is that you admitted the first refusal decision and re-apply with new evidene.

Now you can judge yourself accordingly.

@ Dumba, of all your refusal reason, the second one is what you should focus more on. Did you actually left UK without completing your study? And what stage of your study were you before leaving the UK?

Any applicant who meet all the requirement for any PBS application also need to have in mind that their previous immigration history will be considered when HO treat their application. You must prepare your case very robustly to explain the reason if any why you decide to switch to Tier 1 Entrepreneur rather than continue your study.

The other 2 refusal reasons are things you can easily defend if you have all the documents at hand.

Another question I want to ask is were you given any appeal right? If not what reason did they give for not giving you appeal right?

Being a student can't i leave UK without completing my study and its already been 6 months i left UK. So any idea about this case.

well they give me the only chance to do AR. May be i applied from outside UK so they didn't give me appeal right. But they didn't mention about any reasons for not giving appeal right.

Do u have any idea what sort of reasons is appropriate about my study related things..??

I think it actually depend on what your course of study is and what stage of your study you were and in my opinion, HO always think most people are on student visa not for study but to work, so your personal circumstances will determine your chances of success.

If you can explain your study timeline including course of study and durations, then gurus on the forum might be able to give better advise.

I study IT(2009-2012) certificate given...and switch my course to business in middle of 2012....my visa expired in march 2013 so i couldnt finish my business course ..and instead of extending my visa i left UK and return back home....

I am going for AR ..this will be my first and the last time ..if i didn't success i will say bye bye Uk and invest it in other country as i find its easy and more profitable...

And in the general refusal they said" i applied for tier1 just to enter uk) ..if my intention is to enter uk then why on earth did they think i return back home..?? they are just crazy and give stupid reason .....i guess they just want our application fee...I am not going to give another £900 ..LOL
