ILR if Tier 1 and unemployed for 4+ months

Hello,

Could you please help me in my situation?
I am on Tier 1 visa, eligible for ILR October 2013.
I've been made redundant in October 2012 while being on maternity leave.
I meet all the criteria for the salary threshold as I have received good redundancy package. I also haven't been out of country only for short holidays.
My question is for how long can I be unemployed to be able to get ILR?
Is it 3 months and its too late for me?
I would like to stay with my child until October 2013.
Would it be still possible to get ILR if I am unemployed for 1 year?
I do not claim any benefits.
Any experience is much appreciated.

Hi,

I had a similar query as yours and found out the relevant information on this link

If you read 255 AAA (b), " Except for periods when the applicant had leave as a Tier 1 (General) Migrant........"

it implies that only those who were on work permit would need to have been employed for the five year period without any breaks. Since you are on Tier 1 ( General) you should be fine despite being unemployed for four months.

Hi,

I am on Tier 1 General and going for ILR on Nov'13. And I was unemployed for more than 60 days on 2009.. I have checked the link provided but if you check the link below.. It is applicable for all..including Tie 1 ????

Hi Kumar,

Did you see the link I posted which is of the official UKBA site. Since it clearly states that Tier 1 immigrants are exempt from the continuous employment condition then I would rather follow this than the one you posted.
