ILR query

I want to know about the current circumstances.I was on work permit in 2011.I applied for Tier 1 General that was rejected and i applied in October 2011 again since that it is in Judicial review.I haven't heard from home office.Now,i can't go back to my country to get married.I am applying for study visa (PhD Study) of my fiance after telephonic marriage.If i become dependant on my wife's Tier 4 visa,will it affect my application for ILR after 5 yrs from work permit.2.5 yrs have passed after applying Tier 1 General.
