Previouse Earnings for 2nd Extn - very very URGENT PLZZZZ

Hello All,

I'm applying for my 2nd Extn for Tier 1 General, below are my details

My Initial Tier 1 General Applicaiton granted on 1-12-2008
My 1st Extn was approved on 8th Nov -2011

i'm bit fishy about the below statement with regards to claiming points - do i still need 75 points as per the old rules or do i need 80 points

49. Important -

If you were last granted leave as a Highly Skilled Migrant, as a Writer,
Composer or Artist, Self-employed Lawyer, or as a Tier 1 (General) Migrant under the rules in place before 19 July 2010, and have not been granted leave in any categories other than these under the rules in place since 19 July 2010, you must have 75 points from your attributes
(Appendix A of the Immigration Rules).


If you do not fall into the above group you must score 80 points for attributes. (Unless you are covered by the HSMP Forum judicial review judgment. To apply for an extension of stay you will need to use the FLR Tier 1 (HSMP) application form in conjunction with the FLR Tier 1(HSMP) Guidance Notes available on the website on www.ukba.gov.uk)


Please advise/suggest me ASAP- very very urgent please.

Im applying on 8th Oct

in Point Based Calculator showing only 75 points.

Hi, according to your post you will have 5 years under the Tier 1 General. So, should not be settlement instead of extension?

I'm late comer to UK (Came Sept 15 2010) and got 1st extn on Nov 8th Nov 2011, thats why i have to go for 2nd extn

and that's right. you first got your visa in 2008, same rules apply

I was in the same boat and applied for second extension last month and got it.
You will need 75 points under the old rules, new rules will not be applicable to you.

I applied on 22nd Aug and got an approval on 9th Sept.
