Lost passport with ILR vignette abroad

Hello all!

Can you please help me? I am so distressed by this situation.

Both my husband and I have ILR (he has ILR BRP and I have ILR vignette). Our youngest son was born in the UK and has a British passport.

My husband is currently in the UK and I am in Brazil due to work, but was just for three months and I was supposed to be back by now.

However, my husband send me his passport and BPR, my youngest son´s British passport and my own passport with ILR but it has been all lost on the post (he sent through normal post instead of special delivery). I am opening a court case against the post but the issue is that now I don´t have my documents and I must travel back to the UK otherwise I am losing my job.

The documents were sent to me because we would have applied to ILE for my oldest son but now we can´t.

I am getting my new passport tomorrow but I am not sure under which category to apply. I am not a returning resident as I didn´t left UK for good, I am even employed by a UK company right now.

Can you please give an advice?

how did you travel if your passport and ILR were in UK?

We all travelled to Brazil but my husband went back to UK before us, so he took with him my passport, that´s why.

But that´s irrelevant to the case.

The thing is that all are now lost and I would like to know which type of visa should I reapply abroad to get my ILR back.

But why would your husband send his passport and ur son passport as only the photocopies would have suffice to prove their identity it was a huge risk sending them by post who knows it might have been ceased by the border people who manage the post things by thinking it might was sent for some thing like illegal entry to uk or something.

Well we would never know it would have been lost on the post, that´s for sure!!!

Interesting. So as a returning resident I can just turn up into UK border and claim my entry as that without a visa? And then get a new vignette produced in the UK?

Yes, if you can show that you had ILR when you last left the UK, returning to settle and have been absent from the UK for less than 2 years.

However, it may be better if you can get prior approval or returning residence entry clearance, as the airline may not let you board the plane.

Well, I do have the UKBA letter when they issued me my ILR.

And about not boarding the plane, I don´t think that would happen, as I am a non-visa national.

Whatever happens, do not let the Immigration Officer mistake you as a visitor. Make it clear that you are entering the UK as a returning resident.

Probably best to subsequently apply for NTL or naturalisation.

Ok, that´s fine.

I am applying for returning resident visa just to be on the safe side as I´m taking my children with me.

I submitted my returning resident today, so fingers crossed I will get my passport with visa back soon.

I have received an email today saying my visa has been issued and my documents will be dispatched the following working day. So just waiting for them to arrive through the post!
