(yet another) question about new language requirement

Post by mingon » Tue Oct 08, 2013 6:27 am

I applied for a Tier-1 visa 3 years back and in the process took an English test (from College of Excellence, the certificate is CIELT). The centre/certiface was (or probably is) approved by UKBA.
I got my ILR on 26-Oct-2012 and am planning to apply for naturalisation. Unfortunately 26-Oct-2013 is a Saturday, 2 days before the 28-Oct-13 rule change.
(a) The English certificate has an expiry of 2 years, meaning it has expired, also (b) the centre/certificate doesn't figure on the Naturalisation regconised list.
Would the experts here have any advice please, other than sitting an IELTS which is really a last resort ?
Thanks.

KNOWLEDGE OF LANGUAGE AND LIFE IN THE UK @ Page 11 wrote:Unless you are asking to be exempt then you may satisfy the requirement for both knowledge of English language and knowledge of life in the UK by:
  • • successfully completing a course of study in ESOL with citizenship. You will need to provide a certificate showing the level you have attained together with a letter from the college certifying that the course had the requisite citizenship content. OR
    • Passing a short test on knowledge of life in the UK at a Life in the UK Test Centre. This test is set in English and passing the test will indicate both knowledge of English and Life in the UK. OR
Confirming that you already satisfied these requirements when you obtained indefinite leave to remain (ILR)
However, if you can prove one of the above then, Your date of application will always be the date of posting which can be done on a saturday (although before 1:00 PM at selected post offices)

This is incorrect.your date of application is the date Home office receive the application which will be on Monday 28th. I'm exactly on the same boat, I'm afraid you need to comply with new requirements post 28th October.

Indeed, for immigration, the date of application is the date of posting, but for nationality, the date of application is the date in which the Home Office receive the application.

However, if you met a B1 entry clearance requirement that will suffice.
