Dear All,

I'm a ILR holder and thinking of applying for British Naturalisation,but have a question on the "12 month residence requirements as ILR holder".

Hope someone can help, as my situation is a bit tricky:

Originally I received the ILR approval letter dated 8-Sep-2012 and a Biometric Residence Permit card (BRP) issued around the same time, but unfortunately, I lost my BRP a few months ago and the new replacement BRP I've been issued has a "valid from" date of 8-May-2013. Don't remember the "valid from" date on the original (now lost) BRP , but reckon it must've been around 1st or 2nd week of Sep 2012
My question is : Does my ILR period start from 8-May-2013 or around 1st/2nd week of Sep-2012 ? I do have the original ILR letter from Home Office with 8-Sep-2012 clearly shown on it.

Many Thanks in advance for your help. I'm also planning to give Home Office a call and clarify.

Dear Cityguy0189,

The BRP card is just an ID card and the date on it is not what decides the date of your ILR.

There have been instances where people have been issued with BRP cards with wrong dates.

Then there have been instances where people have lost their original cards and new ones issued like in your case.

The ILR approval is what matters. Also note there have been instances where ILR has been approved after inordinate delays and there is a proviso to apply for BC if the ILR application was delaying beyond 6 months.

Hope this clarifies your doubts. Calling the Home office is not going to help you. Let me warn you , further confusion is a definite possibility :-)
