ILR Requirment

Post by vsk106 » Wed Oct 09, 2013 8:39 pm

Initial HSMP Visa Stamped for Duration: 02/Jan/2010 - 02/Jan/2013
First Entry to UK : 28/Dec/2011
(I came to UK after 2 yrs of visa approved date).
First Extn for Duration : 14/Nov/2012 - 14/Nov/2014.
(I went 45 days before, So they gave from date of approval).

I would like to know, According to ILR requirement shall I need 2 more extensions/1 extension is enough ?

Hi,

Option 1:

You go to PEO and your case is straight fwd. Assuming you will get only two years extension in 2014 on your 2nd extension, you will qualify for ILR 28 days before your fifth anniversary (i.e) 28-Dec-2016.
I suggest you apply for your 3rd Extension right around 14-Nov-2016 and then vary your application to ILR on or after 01-Dec-2016 before it gets decided.

Make an in-time application so that you can vary, see also below

Option 2:

Send by post around 14-Nov-2014 and delay your biometric enrollment upto 14 days. Also you can take the gamble of paying by cheque since it takes few days to clear. This can then (hopefully) put your 2nd T1 Extn start from 01-Dec-2014 Until 01-Dec-2016.

Good luck.
I try to give honest answers, however I might be wrong, kindly always check with your solicitor/accountant for final confirmation

ILR Requirment

Thanks for your reply.

As per the below discussion, I will get 2nd extension for 3 years. If that is correct 1 extension is enough for me

But if they give only 2 yrs, 14-Nov-2016, I will be 46 days short for 5 yrs stay as per ILR Requirment.
