My case history

husband stole brp and sent me to pakistan by force
I applied for replacement visa and found out that he has cancelled my visa. At this point I have withdrawn my application

I want to know what is the best way forward to get to UK to file for my case.

Should i go to appeal process or apply for visit visa.

A successful visa visa will just enable you to visit the UK for a period of up to six months. You cannot usually switch from a being a visitor to another category.

Thank you for prompt reply.

I am on tier 1 dependant visa.

If that visa is cancelled then how do I go back to UK?

I want to file for victim as domestic violence and for that I need to make the application in UK.

Can you please advice the best route for me?

See also Victims of domestic violence - Balakoohi, R (on the application of) v Secretary of State for the Home Department [2012] EWHC 1439 (Admin) (01 June 2012). Note that you won't be eligible for settlement as a victim of domestic violence.

See also VAT28 - Witnesses attending trials in the UK.

Not sure how you will be able to travel to the UK to file your complaint, other than as a visitor.

Thank you again for the links. They have been very helpful.

A police report was filed by my neighbours in May 2013 and they reported domestic violence.

I have medical certificates from here for emotional and physical abuse which date to aug 2013.

I came to pakistan in aug 2013 after my husband beat me up and kicked me out of the house along with my passport. My dad sent me money and I booked seats for pakistan since I didnt have any place to stay. After coming here I applied for replacement brp. Due to excessive visa processing I figured out that maybe my husband has tried to contact ukba to curtail my stay.

At present... I have withdrawn my application so its not certain if my visa has been cancelled. The only reason I am not filing for divorce is that in our religion if I file for divorce I will have to pay him money. I dont have money ! Already he has kept all my stuff! I am wholly dependant on my family and even they have obligations :(

I dont have any children.

Please advice me whats the best way forward? No one in uk is willing to help me while i am in pakistan. They are saying come and meet us in person.

May I also know that since I am a full time student doing masters from 2012-2013 batch... therefore I have to attend convocation.

If my dependant visa is cancelled... can i apply for limited tier4 visa.... till feb? Like the regular students are issued.
