ROR application

Post by Lucky576 » Sun Oct 27, 2013 8:27 pm

Hi forum, i am going to apply ROR application this week, i checked Eea2 form, do i need to fill section 1,4,6,10 only?
I am confused on section 3.... Do i need to fill this ?
I am sending following documents

Passport
Decree absolute
Proof we lived together one year in UK after marriage(tenancy agreement, her P60,letter from employer that we lived work together at same place during that year, her GP card, some credit card applications covering that time, etc

My EX work history confirming she was working till decree absolute.(whole year from when divorce started and when it finished)

Letter from HMRC that she worked through out in the divorce year june2012..feb2013..

Letter clearly states that she worked for ABC employer ... Starting date and ending dates, also a letter which states her NI contribution/tax calculation covering divorce period.

My last 5 years P60s,4 payslips each year....
Is that everything sufficient?

ROR?? If you mean Retained right of Residence due to divorce,I 'd suggest you use the EEA4 to apply for PR. Evidences is ok but follow guidelines to check if you need more.

i don't think it's necessary to include your payslips for each year. You must include the one after divorce .

I don't think they will even look at your P60 / pay slips before divorce finalised

Thanks for replies
Can you please answer that i have to fill section 1,4,6,10 only in Eea2 form.
Do i need to fill section 3 aswell?
Or simply which sections i need to fill in form Eea2 to apply for Retain right of resident????
I can't apply PR,because my EX had an employment break for one year.
My timeline
Married june 2009
Lived one and half year together
Than lived separate until divorce(oct 2012...feb2013 divorce period)
Ex had a baby and living with someone else soon after our separation,
So marriage last 3.7 years, in which we lived one and half year together.
My Ex didn't work during pregnancy/birth (1.3) years
She started worked in feb2012 and still working same place.
So basically i secure Retain Right of Resident as she was working during divorce until decree absolute...

I will send only the proof of mine after divorce...thanks askmeplz82
Will the proof of my Eea EX be enough to secure ROR which i mentioned in my first post? HMRC letters and tax calculation for year 2012/2013 till divorce finalised ???

Yes Section 3 about your Ex ; that's the only section where you include EEA national information

1,3,4,6,10

HMRC letters and Tax calculation is OK but you know Home office case workers love to find a reason not to issue a resident permit.

i think there is 90% chance they will not ask for any more documents and 10% chance they may just refuse you saying it's not enough which they did to many applicants even in this forum

But do not worry whatever happen you WILL WIN at the End because your EX was exercising treaty right during divorce and you tick all the boxes
