Hi,

I got the letter from Visa consulate stating that :

"I got a letter stating that :

You claim to have obtained a further 45 points for
income , meaning earnings of 7500 GBP or more. You
have provided an income tax return covering the period
of 1/4/05 to 31/3/06 , however it not clear why the
total income is much lower than the salary certificate
provided by your company. This undermines the
credibility of papers provided in the company name.
You have also provided bank statements but these do
not cover the majority of the relevant period under
this scheme I am not therefore satisfied that you have
obtained the income as you have claimed. I further
note that on your application form you have stated
your work address as one in the USA , however you
clearly do not actually work there , as you have never
travelled outside India. You have failed to provide
any contact point for your company in India as your
work place.This udermines the credibilty of your
claimed employment income. "

I am working for a company which is situated in US from my home in India for the past 2 years. The company does not have any presence apart from me here in India.

Where they need a address over here in India , I have to give only my home address as a reference for them which will not be very much valid. So I gave them the address of my client in US.

I had filed a IT return for 2005-06 which consist part of my present employment in that period for which I have done the IT returns. For reducing the tax I have given a split on my salary which might be contradictory for reviews.

I just need to know what can be done to get EC over here , or what kind of proof can I submit which would support my presence and also my earning power over here in India.

You should have explained to the type of work you do for the American company, and also how you work (that is working from home)

also getting a letter from this company would have helped, i think

Is the difference between the tax return and the earnings claimed equal to the tax paid? Did you claim net rather than gross earnings? Or is it that the tax return covers a period different from the period for which you claimed earnings from this firm in the US? It sounds like you're not an employee but an independent contractor, meaning that the US firm would have paid you the gross amounts, leaving it to you to sort out the tax payable in India. Perhaps you could explain who issued that salary certificate (presumably not the US firm), the period it covers, and why there's a difference between it and the tax return. And turn in the invoices and bank statements as well for the relevant period.

And as a contractor, your workplace would be the place where the work is conducted (ie, running a consultancy out of your home, for instance, in India) rather than the physical source of the earnings (the US). This is what I did in my EC application, since I'm an independent contractor in the US with consulting income (in part) from an organisation in Switzerland.


You'll want to be very explicit on how the entry clearance officer should interpret the documents provided; this is not something best left to the ECO to sort out for himself.

its definitely a unique case; u shud have explained it in a cover letter and provided yr job status on a leter head from US company.......

Thanks a lot for your valuable information.

I need to know whether we need a bank statement for
last 6 months or for last 12 months.

Is it a must to keep Income tax returns for 2005 -06
or instead of that can I keep the following
statements:

Salary Certificate for last 12 months

Individual salary statement for last 12 months

Chartered Account statement for last 12 months

Bank Statement for last 12 or 6 months

Bank statement stating that my salary for last 12
months was deposited in my ICICI account


Will these documents be fine or IT returns is a must.
