Hi Sam73,
I will tell you my own experience, i got divorced and than i applied for retention of my residence card. My retention was approved and i was advised in the same letter by EU Treaty Rights Section that " Dear xxx, as you are granted retention of your residence card, you are now advised to apply for permanent residence card on your own rights".
Next week, i applied on Form EU3 for my permanent residence card, and i did not gave any history of my wife and i put a note on all the sections that were related to my ex wife, ( I have got retention of my residence card and i am applying for permanent residence card on my own rights). I have attached the retention letter with my EU3 application.
DOJ, was still seeking info for about six months about my wife's activity in the country, proof of addresses etc etc, i provided what ever i could and every time i was sending them the retention letter with a cover note, that my permanent residence card application is on my own rights as i am granted retention.
And on the last day of my six months, i got approval for 10 years....
