You should be careful with the word overstay, as that implies you breached your conditions. For a PBS application, so long as your absences are <180 days per 12 month period, you should be ok.

that means i don't have to have any documents? even if i stayed more than >180 days but not continuously for 12 months.

can i apply for same day application?

does my mrs qualify to apply as well? she cam to uk in sept 2013?

if she qualified can she apply same day application? and do i need to show maintenance funds?

if she is not qualified can she apply dependent on same day? or later once i have get my settlement visa?

last questions the PBS says i will have points on age at the time of application first granted to leave in may 2009? is that right?

You should be able to apply PEO if you meet the requirements. If your dep first arrived in the UK in 2013, assuming she was granted leave as a dep after July 2012, she will have to be on such leave in the UK for 5 years before being eligible to settle.

ILR -ABSENCE

Post by kk1020 » Mon Nov 11, 2013 1:35 pm

Hi guys,
Am having a query regarding my ILR..any clarifications on my issue would be very much appreciated.

Status:Tier 1 (General)
First grant of leave Tier 1 : Apr 1st 2010 (3yrs)
Second grant of leave :Till Apr 1st 2015(2 yrs)
I travelled to India for a holiday on Nov 1st 2010 and came back on March 1st 2011.That makes 118 days of continuous travel leaving the entry and exit days.

Apr 1st 2015 Apr 1st 2014 (Predictive) 0 days of absence
Apr 1st 2014 Apr 1st 2013 0 days of absence
Apr 1st 2013 Apr 1st 2012 0 days of absence
Apr 1st 2012 Apr 1st 2011 0 days of absence
Apr 1st 2011 Apr 1st 2010 118 days of absence(61 days in 2010,59 days in 2011)

My query is am I eligible for ILR in Apr 2015 28 days before my visa expiry or I have to go for another extension for breaking the 90 day continuous travel rule.
Am a new member..plz give me some advice on this issue.
THANKS IN ADVANCE
