Business visa or tier 2?

Post by Andy1111 » Thu Nov 14, 2013 3:09 pm

Hi,

I have recently graduated from the UK and currently on a Student Visa which will expire end of this month.

I have an offer from an Indian company in Delhi. I will be employed in India but sent to UK immediately in 2 to 3 months on a business visa which is usually for 6 months. But they need me only for 6 months and after that I will have to go somewhere else.

How convenient do you think it is to switch from Indian business visa to UK to a tier 2 visa if I get a job in UK itself? I am worried that it will be difficult to switch.

I might also get a local tier 2 job in UK this week on tier two. But it is not of my interest at all so I am not that keen. Is it easier to switch from tier 2 at one employer to tier 2 to second employer in the UK?

Thank you for your help.

Do you mean business visit visa or will you be sponsored by a UK entity? A business visit visa will not permit working in the UK, but you can have meetings, etc on behalf of your Indian employer. You can't switch from visit visa to Tier 2.

Thank you for your reply.

It will be a business visit visa. It will not be sponsored by a UK entity. I was hoping to be here on that visa and then look for local jobs. I thought since I would be in UK I can attend interviews etc.

What is your view on that?

My aim is to stay here on a legal basis and have a proper job. I just need to decide between two visas.

Yes, but you can't switch if you do find a job.

Sorry for asking so many questions but I am still a bit confused with the whole visa process. I have also looked at UKBA pages.

So is it right to say I can only switch from Tier 2 to Tier 2? and hence it is better to just take a local job here if I can get it on tier 2 visa? and then try to move to another local job on tier 2 visa?

You can switch from T2 to T2. As to what job situation is best for you, that's really for you to decide.

Many thanks for the reply. I just found that the T2 job that I was getting won't happen any more due to salary bracket limitations (they are paying less than 20000 pounds).

My only option is to go back India now. Do you think it is a better option to tell my employer to get their company registered here in London so they can sponsor my tier 2 visa? They are really keen on keeping me in London. The process could take 3-4 months to register a company here, get a license for company to sponsor visas and then give me a T2 so I can come here. Then this will be the equivalent of hiring someone directly from India.

how realistic this is?

Many thanks again. I might have a few more questions.
