Start date on COS later than COS expiry date ?

Post by jakky88 » Wed Nov 13, 2013 3:42 pm

Hi,

I have been issued a COS by my employer on 12 Nov 2013. COS expires by 13 Feb 2014

However the start date on the COS is 19 Feb 2014.

I am aware that my date of application cannot be more than 3 months as that of my start date. Hence I believe I would have to wait until 20 Nov 2013 to start my application. Am I right ?

My question here is, whether it is alright for the start date (19 Feb 2014) to be later than the expiry date of the COS (13 Feb 2014).

Many thanks in advance.

The expiry date of a CoS is merely the date it must be used by, i.e. you have to apply before 13 Feb 2014

The start date on the CoS, 19 Feb 2014, means that yoou cannot start work as a T2 migrant earlier than this date

Hi Manci, just adding to this topic, I have a related question.

I'm switching from Tier 4 (expires 23/01/2014) to Tier 2 and the company asked me what the Work start date for the CoS should be. I'm legally working for the company on my Tier 4 visa (permitted 40 hours after end of uni term).

Should tje Start Date be before my visa expires (e.g. 22/01/2014)? In case I get the visa beforehand (for example 27/12/2013), am I not able to travel until the next one starts?

Any advice on which dates I should suggest would be much appreciated.

The work start date can be any date from the date when the sponsor assigns the CoS up to the day after your T4 visa expires.

Your T2 application must be made in the period starting from the CoS assignment date up to the date when your T4 leave expires.

Choose the date of application to suit your travel dates as with the application you'll have to submit your passport.

Hi Manci,
Thanks so much.

Just a final point. In case I set the work start date to 10/01/2014 and I manage to get the T2 visa processed before the end of 2013, would I be able to travel around New Year's Eve, for example (that is, before my T4 expires and my T2 starts)?

Thanks again!
