fresh app for tier 4 in 28 days and Judicial review tier 1

i know after upper tribunal we can make fresh application in Tier 1 ent or any other category. i don't want to reapply for tier 1 ent now. i know i can apply for tier 4 in 28 days but can i go for judicial review for Tier 1 entrepreneur as well same time. Some one told it could be possible because 28 days rule does not apply when case is in judicial review. Expert answer Please

My question is do u have to file for judicial review after withdrawing yr appeal( or may be after the appeal deadline is gone in which u didnt appeal)?
secondly what exactly do u write in JR. and does the JR stop u from being removed from UK? i will appreciate if u answer these questions. thx
