EC Rejection-Possible Options now

Hi,

Unfortunately my EC application is rejected.
They rejected on grounds that I am claiming 45 pts on Salary whereas I am eligible only for 25.
Interestingly I provided the same HSMP set seeing which they gave me HSMP approval to start with .

I have been provided a form which I can fill and Appeal if I think i have a case with supporting documents.

Has anyone on this forum have any kind of exp in this.
I have seen people going for re-applying EC rather then Appeal. whats the time frame for appeal getting answered?

Re-applying I am bit averse now, because one it will cost me another 50k plus for self and dependent plus if they didnt read the documents provided first time , how to believe this time you would be lucky !

Any suggestion welcome.

Note-My salary case was on pro rota basic.I was in the UK for 5 months and India for 7 months.,
As per guidance note in such case , they will cal salary for where u have spent most time, ie India for 12 months.
Looks like this PERSON doesnt care to read that in my document and only calculated pt based upon 7 months Indian Salary !

Hi umang,

that's a shocking news for me yaar.........i simply can't believe, why this people do double check with HSMP letter.....i mean, u apply to HO , pay money, get the evaluation done and get the approval letter......and saala this visa people check the same thing again and reject......its a waste of money yaar......

anyway, i think in ur case you have to make a document stating very clearly about ur UK salary and indian salary and prove that .....this is how i am eligible for 45 points.........i think u should appeal rather than re-applying......since if u re-apply that means u are not standing still with ur early documents, visa officer can feel.......better u appeal and give all the explanations in form of documents....this should help.....rather than putting money again......

Yeah it has come as a rude shock..Anyway I am going for option of request for Review.

Appeal as i am told is painfully slow..may take 6 months to 1 yr for any decision.

review request shd be quick.

Will keep you all posted and lets see
