ILR Query

Post by sadiq.wmin » Mon Nov 18, 2013 2:19 pm

Hi,

I am inquiring for my friend.

He came to UK as student dependent in Oct 2003.

His Wife was student
He was dependent
1 child was dependent
1 more born in UK and made depended.

when he completed 9years his wife college was removed from HTS and he got 60days to re-addission & apply into another college.

with in 60days - he applied Discrinary Leave - on basis of private life & Kids etc.... he was granted Discrinary leave for 3 years till 2016.

Now, he completed more than 10years....

Below are the question

1. Can he apply for ILR through 10years ?

2. Does he has to apply 4 different ILR application forms ?

3. He & his wife got degree in INDIA, Does he need to write B1/B2 english exam ?

4. what is the process of making Indian degree's as a proof of equivalent bachelor to UK ( NARIC - is this a simple process)

5. he is ready to write english exams, what the authors preference...
Write english or sort indian degrees with NARIC

Thanks in advance.

1. Yes so long as he has had 10 years (-28 days) continuous (click) valid stay in the UK. Seems so.

2. His leave to remain should have been for 2.5 years, what leave has the spouse and non-UK born child currently got and how long has the spouse been in the UK. The British born child does not need further leave, instead can apply to register as British (section 1(3)) as soon as you are granted ILR.

3. So long as the degree is comparable to a UK and was taught in English it will suffice B1 in addition to LIUK for KoLL. If the degree is awarded 30 points for qualification and 10 for English Skills on the PBS calculator, a print out with the certificate will suffice.

4. If not on the PBS calculator, a NARIC statement of comparability and proof the degree was taught in English.

How long has the spouse been in the UK? The spouse and non-UK born child have leave till 2016 as well I take it?

If the PBS calculator awards the necessary points (30 - qualification and 10 - English Skills), that should suffice in addition to LIUK.
