Post by nilli_13 » Fri Nov 15, 2013 12:21 pm

hi
I would appreciate some advice on applying for my husbands visa (spouse visa) I want to sponsor my husband which is currently in Pakistan we got married in march 2013. I have been claiming carers allowance for 6 months and have worked part time for 5 months but doing a 0 hour contracted job.
also I have 18 ponds cut off my carers allowance for the mean time to pay some debts. I live with my parents and don't pay rent my approx. earning from the part time job is £400 a month but it varies I get £59.60 a month from carers allowance without the deductions.
I am looking to apply in December.
plz advice what documents I will be needing .
thanku

As you are receiving Carer's Allowance you are exempt from the financial requirement but must still show adequate maintenance and accommodation. Do you have dep children? Your income per week should equal or exceed £112.55 Net (after deducting any housing costs). If you can satisfy that, the leave to enter should be granted. See Chapter 8 Section FM 1.7A for further details. Your Carer's Allowance and earnings (NET) can contribute towards the adequate maintenance.

So long as you can show earnings that meet adequate maintenance in addition to your CA that should suffice. The fact that you have a zero hour contract should not necessarily mean a refusal.

Ayush12 your situation would be dealt with in the same way as your are still exempt.

nilli_13 you'll have to average, perhaps over the last 3 months, supplying wage slips and bank statements to prove this, unless the is contradicted in Annex 1.7A.

thanks 4 ur reply I am thinking to apply in a few weeks time. I have 5 months wage slips, 6 months bank statement about £1500 savings and a job offer letter for my husband. a letter from employer my contract. money transfer receipts, phone bills, wedding pics and wedding certificate, docment from dwp confirming carers allowance.is there any other supporting documents that I can provide as I am confused and really want the visa to approve the first time as it has been hard for me. and is there a supporting letter I can hand with the documents.
also in my dwp documents it says mrs and on payslips it says miss is there anything to support this. as when I started work I had no proof of letters saying mrs and most of my payslips was miss so I did not change it later as I thought it would be confusing.
thanku

The job offer is irrelevant as:
section 4 wrote:Only employment income of the applicant if they are in the UK with permission
to work can count towards the requirement to be adequately maintained. Job
offers or the applicant’s prospects of employment will not be taken into account.
What you have should suffice, just show the marriage certificate for proof of the name.

Just a letter on official paper and/or company stamp stating how long you have been working and how much you have earned in the last tax year should suffice.

Hello
I have just recently claimed carers allowance as before my sister cared for my ill mother but recently she got married so I have now tooken over to care for my mother.
I have not got married yet but I am planning to get married to my fiance in pakistan. I recently read if I claim carers allowance I do not need to make 18,600. I will also be applying for income support aswell.
can you please give me more details on what I can do further and what to do after marriage. Also how long do I have to be earning carers allowance to apply .
