Citizenship for kid born in India with both parents on ILR

Post by vipulasher » Thu Nov 21, 2013 8:57 am

Hi,

We moved to India in April 2013, our kid was born in June 2013.
Both me and my wife hold UK ILR (issued Nov 2012) and I am trying to find out if I can apply for British passport for my kid through India. We intend to be in India until June 2014.

If so, what is the process/documentation? Please help.

He is not British but can apply for a settlement visa when you return to the UK, and naturalise after 3 years of residence.

If you return to the UK and the child is granted ILE, then when you both apply for naturalisation in the UK the child can apply at the same time to register as British under section 3(1), there should be no need to wait a particular period.

Bare in mind absences for naturalisation (click) and returning residents for your ILR.
