Few questions regarding immigration

Post by Arj » Tue Mar 30, 2004 6:04 am

Hi friends,
I got HSMP approval letter on 24th January and my last date to apply for entry clearance is 24th April 2004. Now, we can spend 6 months out of 4 years of stay in UK outside it for vacation.

1. After getting entry clearance, I am planning to go to the UK in July. So will these three months be counted as my time outside the UK, or will my 12-month time start from the time I enter the UK?

2. Also could you please tell me whether I can let my family stay in India up to six months so that I may first find a job and accommodation before my family migrates? Or do they also have to migrate along with me?

1. Your HSMP visa is valid for 12 months from date of issue during which time you can enter the UK. Your HSMP renewal will be at the end of this 12 months NOT that from your 1st entry into the UK. Renewal success is based on your economic activity over the 12 months visa validity - if you have only been in the UK for a short time then you will be unlikely to get a renewal because you are less likely to have established your self in business or be in employment. HSMP Team won't buy the 'I have only entered the UK recently' plea - after all you signed a declaration saying you intend to make the UK your home.

2. Sure and probably quite a wise move. Note that if you got the 10 additional points from your spouse he/she must join you in the UK - this would typically be at the renewal stage although the Entry Clearance Officer may enquire as to why you are the only sole visa applicant. My advise is usually that applicants apply for everyone's visa at the same time.

Good Luck

Thank you for the reply :) I appreciate that help.

Could you please tell me whether my dependents would have to get their EC along with me? Or can it be done after the 3-month period set by HSMP team.

I have read in discussion boards that applicants have 3 months after EC in which they must enter the UK. Do my dependents also have the same 3-month time limit? Or can they come later?
