Tier 1 to ILR dependant

Post by Aani » Mon Nov 25, 2013 4:06 pm

Hi All,

I am due to apply for my ILR next year this time. Me and my husband both are in Tier 1 (we are not dependant to each other). He is due for his ILR in 2015. Now, when i apply for ILR next year(2014) is it possible to include him as my dependant.

The benefits of this are

1. My husband will get ILR 1 year early.
2. If he is applying independently for his ILR We will have to spend somewhere around £1000 extra. We could avoid that if it is joint ILR dependant application.
3. He need not have to worry about meeting the PBS points once again in 2015.

Having considering the above points I would like to include him as well with my ILR application. I was wondering is it that only Tier 1 dependants can become ILR dependent and we don’t have route of Tier 1 to ILR dependent directly?

Please can experts advise on this?

He will not get ILR faster if he becomes a dependent or partner of a settled person, that would be another 5 years! Best stick as a PBS applicant I think.

Thanks Moderator. After reading your reply and after going through UKBA website and other forum threads yes, it is good to stay as PBS applicant rather than becoming ILR dependant.

Thanks once again for your suggestion
