ILR - dependant question and minimum income

Post by rabiulhuq » Sat Nov 23, 2013 10:19 pm

Hi There,

I am currently on a tier 1 general visa and will be applying for ILR in March next year.

A couple of questions:

1) In my first 1.5 years in the UK my taxable income was lower than £30,000. Would this be an issue when applying for ILR?

2) My fiancée is currently on a tier 2 sponsored visa through her company.

We have not set a wedding date yet but are considering whether we should get married before I apply for my ILR so that she can apply as my dependent. (Note - we have not been living together for 2 years)

Ie she would transfer from a tier 2 sponsored visa to be a dependent on my visa.

Can you please advise if this is possible? And if so could she do an in-country application and what length visa would she receive.

Many thanks

The salary shouldn't be an issue so far as you meet any required points now.

Your spouse may either apply as a PBS dep before you go for ILR or she can apply for FLR(M) once you are granted ILR. Note that FLR(M) will have a financial and English requirement. For both PBS dep and FLR(M) the time to settlement would be 5 years.
