HSMP granted while in UK, do I have to leave???

Post by chezzy » Wed Jun 20, 2007 1:47 pm

I was granted HSMP status while visiting in the UK and a job offer came up. Do I need to leave the country and re-enter in order to work?? If so do I need to return to my country of origin (USA) ?

I think I do need an EC. Unless I can get leave to remain and switch my status. Any thoughts?

So, you were in the UK visiting - as in not on a visa? (because Americans can come in to visit without one).

I agree with SYH, I think you have to go back to the US to apply for EC. I would check the guidance notes for HSMP as to the guidelines for in-country FLR, but I'm 99% sure that in order to qualify for FLR, you must already hold another visa type.

If you're just there with a visitor stamp in your passport, you're in the same boat as you would be if you were standing on US soil.
