ILR for Child born outside of OK

ILR for Child born outside of OK

I will be applying for my ILR in March 2014 as Tier 1 General migrant. My wife and two kids have previously been granted leave to remain. My wife has not completed 2 years continues stay with me in UK and hence, i will have to apply for her extension. But i am confused about my two kids. Can i apply for their ILR with me (they have also not completed 2 years with me). Both of them were born outside of UKL and both of them have been given entry clearance previously.

It depends on when they had initially applied for entry clearance as your dependant (before or after 9th July 2012?), as their ILR is subject to 319J.

Hi Vinny,
Thanks for the swift response. OK i have read 319J now. As per point (iv), if the child was given entry clearance before 9 July 2012, then the child is eligible for ILR with the principle applicant. One of my Kid was granted permission to leave to remain in UK before July 2012. So i take it that he can apply with me for ILR and then i will apply for my wife and the other kid for extension. Please confirm
