Tier I General Migrant Visa to ILR Absence concern

Post by Arezk » Fri Dec 06, 2013 3:02 pm

Dear All
This is my first time in the Forum , I wonder if you can assist me in my question. I am currently a working residence in the UK under Tier 1 General Migrant and I will complete a 5 year period in Nov 2014 to apply for ILR. I have a concern about the period of absence I am allowed to have per consecutive 12 month .
I have been in multiple business trips from Nov 2010 to Nov 2011 with bursting period not exceeding 60 days in one mission. However I accumulated more than the allowed period between Nov 2010 to Nov 2011 in which more than 180 days ( around 260) . I can provide business and employer justification for each of these business travel , however i am not sure if this will impact my ILR application if I applied in Oct 2014 ( my T1 expiration date). IF it will , do you know what should be the solution?

I really appreciate your help and assistance.

Hi Arezk,

I am not an expert in this but I have read on the forum itself and read on UKBA website that if you can go for another extension of Tier 1 when you fall short of the required 5 yr period for ILR.

Hope senior or experienced members confirm this.

Good luck.

Hi acg
Thanks for your answer and appreciate your help. If that will be the worse case scenario , do I have to wait for the whole period of the extension of T1 to apply for ILR or to a sufficient date i know it will not accumulate more than 180 days per given 12 consecutive months from that application date.

I hope I don't have to do it and apply directly in my time ...appreciate your help and assistance on that guys.
