Hi,

I hope someone can help us. we contacted UKBA call center and we are more confused with all the answers (':roll:') . I am an Indian national married to the Belgian National who has been working in the the UK (exercising treaty rights). I hold an Indian passport but I have an indefinite leave to remain status. My Husband holds Belgium passport and we both have been living here in the UK for more than 5 years. He automatically has an indefinite leave to remain since he has been working in the UK for more than 5 years (according to EEA national information on UKBA website). So we both have a settled status here in the UK . We both have been working here, paying our taxes here and are registered here under local authority for more than 5 years.

The question is, we are expecting a baby next year in May/June 2014 and it will be born here in Britain and it will be living here with us in the UK and registered under our local authority. We are confused about the citizenship/ nationality of the baby? I have read the UKBA website about the citizenship of the baby.

On the above link it says the child will automatically be a British citizen since we both have a settled status here in the UK and have been living here for more than 5 years.

But when we rang UKBA call center they advised us it will be Belgian citizen after the fathers nationality ??? And to register a baby here they have asked us to fill in a MN1 form ??? We have read the guide to MN1 form and the information on UKBA website

the above information link suggests " Children who have automatically become British citizens do not need to register"

We are totally confused. Please could someone give us a clear answer on what citizenship the baby will be when it is born in June and if we need to fill in MN1 form and pay £80 for ceremony or can we just normally register like everyone does here in the UK ? It doesn't really mater what citizenship it will be for us. Its just that we are overloaded with information and if we are thinking of travel for a week holiday to Belgium to show the baby to extended family and we need to know what passport to apply for or what nationality/ citizen the baby will be ?

I hope someone can help! I have also contacted FurtherNationalityEnquiries@ukba.gsi.gov.uk . Not sure they will reply. They keep reverting me back to the UKBA website (':(')

The baby will be British by birth as you are both settled (ILR and PR) and no need to register on MN1 and you can apply for British passport directly.

If born in the UK, the child will be British (and probably also Belgian and Indian). Getting a UK passport would be probably the quickest way to get a travel document. Just apply for a passport using the child birth certificate and one parent proof of Settled status (probably your ILR status would be the easiest to show). Should take 2-3 weeks to get it.
