switching to tier 2 during appeal process, plssss helpppp

Dear all
my tier 1 entrepreneur visa got refused based on my previous immigration history which has 320 (7b). I was awarded all points required for requirements.

Applied: Nov 2012
Refused:May 2013
Hearing: Feb 2014
all funds in the UK still since Nov 2013
comapny still active
All points awarded
Reasons for refusal: previous immigration history of 320 7B in 2008, but approved psw in 2010 during which i disclosed when i applied for psw and was granted.

I recently got qualified as a doctor here. One of the surgeries is willing to sponsor tier 2. My worry is can I get Tier 2

well looks like its deception. there is nothing u can do about it but appeal and stand on the ground that u were approved visa before. but what was the deception about?

well then the chance is really low being very honest

It might be helpful if you get advice from a specialist lawyer

OR

wait for your appeal to be finally determined, if your appeal is allowed and you get Entrepreneur leave then you can switch to Tier 2 as a doctor.

If you apply for tier 2 whilst your appeal is in progress then its likely that they would refuse again on the same grounds.
