Hi All,
Good News!
We were granted ILR for all three of us my husband, our son and myself, though they took a long time before giving a decision. Our appointment was at 9.30 am and our documents were submitted by 10.00 am. They asked us to return after 1.5 hours, but when we went back they kept us waiting until 3.30 pm. Only then, they gave back the documents and the confirmation letters.
Thank you all for your kindly advice and support which helped us a lot in this process.

HI all,
Yesterday we were granted ILR for both myself and my wife in Croydon PEO.
It took between 1 -2 hours to get our decision after submitting my application.
Thanks for all of your help and useful posts which gave me confidence to apply on my own without needing any ripp off fee for lawyers.

Hi
I am on Tier1 G and due to apply for ILR end of December 2013.
My husband is on has been on his own post study visa and switch to my depandant only in March 2013. By the time I'll apply he will be my dependant visa for 10 months only. However we can prove for cohabitation for the last 2 years. Bank statement on both names, driving licenses on same address etc.
Will it be possible for him to apply for ILR with me.
Please experts let me know.

Hi All,
I am current on Tier1 General and will be eligible for ILR on 12/03/2014.
My wife was given Tier 1 General dependent Visa on 28/02/2012 expiring on 12/03/2014 from Pakistan. She came to UK on 04/04/2012.
I know she qualifies for ILR based on two years stay rule. My question is:
a) Are these two year worked out based on dependent Visa issued date? i.e. 28/02/2012 to 12/03/2014 ... which makes is just over two years and we are fine.
b) Or .. these two years are counted from when my wife entered UK? i.e. 04/04/2012 to 12/03/2014 ... which makes it about just under 2 years. About 1 year , 11 months and 8 days and we are in trouble.
If the verdict is case B and she will be in UK for about 20 days less than 2 years then what will be coarse of action when her visa expires?
What do I need to do? its very very close .. and I really hope that UKBA takes the visa issue date into consideration which means I can apply for both of our ILRs together.
Look forward to hearing from you.
Thanks,
-

I am writing to enquire about few things on ILR:
I am currently on tier 1 ( general) visa and my 5 years are getting completed on 7th of april 2014 on this status. My current tier 1 visa will expire on 7th of june 2014.
My wife is with me here in the UK (tier 1 general partner) and has joined me on 1st of october 2012. ( her visa stamp dates are 20/09/2012-07/06/2014).
My question is :
- can i apply for ILR SET(o) form for myself and my wife same time after 7th of april? I have read somewhere that wife has to be with me for 2 years in UK?
If no what should i do
Help is much appreciated

Iam on Tier1 General, now eligible to apply for ILR.
My wife Got her Tier1 dependant june 2013 (7 months back), and I would prefer FLR(M) over PBS Dependant. She did her Bachelors of Technology in IT from Anna University (B.Tech IT). THis was Taught in English, but no where in her certificates it says that.
Now:
1. Can I use her degree certificate as proof for her english language requirement.
2. In her case, is there any advantage/disadvantage or benefits for her being FLR(M) over PBS Dependant (and vice versa).
Experts and Seniors please reply
Thanks,

Is the degree awarded 10 points for English Skills and 20 for qualification?

Then a copy of that will suffice for FLR(M).
Assuming you're applying for ILR as a PBS applicant not long resident. Settlement time may be reset with FLR(M). FLR(M) has a Financial and English requirement. PBS dep is just maintenance.

Thanks for the Quick reply Amber,
Ok, Now I shall submit a Copy of her degree certificate for English language requirement.
Am applying for ILR as PBS applicant (Tier1 General).
Since her arrival in the UK is just 6 over months (june 2013), she doent mind the reset of her settlement time, considering the fee for PBS dependant as GBP.1500 odd where as FLR(M) it is GBP.500 odd.
Is it possible for me to apply with PEO on the same day for me and my wife.
Me for ILR and my wife for FLR(M) on the same day with a PEO appointment.
Thanks,
-

That would be up to the caseworker, I would side on caution and perhaps make it after your ILR.

Hello Gurus,
I have 2 queries , Regarding my eligibility for ILR and Regarding my wife's eligibity as ILR dependent.
1. I came to UK in Oct 2009 under tier 2 ICT visa and switched to Tier 2 General Visa through a new UK employer in Feb 2014. I complete 5 years in UK in Oct 2014 and all this time I have been working in UK (with annual leaves not more than 40 days in a year and total 90 days in all 5 years)
My current Tier 2 general Visa is valid till 2017. Am I eligible for ILR and should I apply for ILR now or should I wait and utilise tier 2 Visa completely for another 2 years and then apply for ILR. I fear ILR rules getting changed in next 2 years with UK elections also in future.
2. My wife entered UK in March 2014 as Tier 2 general dependent and her Visa is valid till 2017. What is the eligibility for her to apply for ILR dependent. What is the minimum UK stay period to be eligible for ILR dependent? Can she apply for ILR dependent with my ILR application. Also if she does not satisfy minimum UK stay period eligibilty can she remain in here present Tier 2 General dependent Visa even if I get ILR? Won't her Tier 2 general dependent visa get void as soon as I get ILR ?
Please suggest the best way for both of us. Thanks

Hi Sam,
Please can you advice .am in the same situation now.
Please can you advice .am in the same situation now.
I live in UK since 2010 and am eligible for ILR visa.
My visa status – Tier-2(2010-11) & Tie1-General (2011-Till date)
Regarding my dependants ILR
1)My wife lives in UK since 2010.Due to personal reason she was away from UK on following days.
10/10 – 12/10 (60 days)
11/11 – 04/12 (90 days)
04/13 – 11/13 (210 days)
11/14 - 03/15 (120 days)
As per UK ILR Visa rule, dependant should live in UK for 2yrs and shouldn’t be away for more than 180 days.
Please advice – 2yrs period any time in last 5yrs or immediate 2yrs
2) My daughter was born in India and came to UK in 11/13
Please advice – Does 2yrs restriction applicable to baby with less than 2yr?
I gone-through all post in immigration board to get advice but couldn’t find relevant answer for my case. Please direct me, if these query has been answered on different topics.
Thanks in advance.
Regards,
Durai

Hi Durai,
Does she had any break in her visa? Even if she was out of country for more than 180 days if her visa was valid there shouldn't be any problem. Can you show various cohabition docs for past 2 years?
If your answer is yes then you can apply it for her. I was kind of in the same situation and I applied for myself & my wife only and got the ILR. Now I am planning to apply for my daughter. so you can split the application as well if you want.
Cheers,

Hi Durai,
Yes all the documents you have listed will help if you have it available. Also if possible try getting a letter from GP about her first registration date if you are registered to only one GP from beginning, driving license, bank statements, etc.
Cheers,
