Actually, the OP doesn't currently have an Irish passport. Whether or not he has exercised his right to be an Irish citizen via another method is unknown but, in any case, in the example you suggested, the OP would return to the UK and complete (or, rather, the spouse would complete) the EEA2 form declaring the OP to be a UK national returning under Singh. The UKBA, to my knowledge anyway, are not currently investigating returning "Singh" UK nationals to discover whether or not they are also a citizen of the Member State from which they are returning have pursued economic activity there.Greenie wrote:What is ukba's current position in cases where a dual British national seeks to use the surrinder singh route having worked in the the other country of their nationality.
