Exercising treaty rights and Jobs bridge

Post by Latintraveller » Sun Dec 29, 2013 11:40 am

Maybe Brigid or someone else may know the answer to this question.

I am exercising my EU treaty rights in Ireland as a self-employed window cleaner so my family may live with me under the terms of the directive. I have a Degree in Computing and after graduating worked in a school in the UK managing an e-Learning system. Since there has been a public sector recruitment embargo in Ireland there are few (if any) of this kind of vacancies here. Recently though a "job" (or scheme) that is very similar to that which I carried out in the UK has become available as part of the Jobs Bridge programme. I am currently getting a little dole as "top-up" to my low wages. I was wondering if I applied and was successful regarding this vacancy if I would still be "exercising my EU treaty rights" and whether my Stamp 4 family members may remain.

Your thoughts and advise would be appreciated.

I notice that the directive mentions "worker". I understand that an intern on Jobs bridge is not an employee, but according to my understanding he was a worker as that is a verb rather than a noun.

May someone reply!

It is actually a complicated question, but there is an easy answer.

If you continue to work on a self employed basis, then you continue to be a migrant worker, and continue to exercise EU rights.

So the simple answer is to continue with self employment, pay the necessary tax and prsi on the small profit from this, and apply for Jobbridge also. Jobbridge is unlikely to have a requirement that you cease self employment, as this would defy logic. So that approach solves your problem completely.

If you want to give up the self employment it becomes more complicated. In this case you would need to ask social welfare in writing what class of prsi is payable for you if you go on the job bridge scheme - if it is class A then you are an employed worker with all the rights of an ordinary worker. (I don't know the class of prsi offhand, there are so many schemes that I would need to look it up and sometimes they change the class of prsi associated with some of these schemes).

Will send you a pm about a possible job in your area of work.
