I need Help My Hearing Date is 12th Macrh

Hi All,

I would like to request you to please help me as I am in big trouble. I know you guys are very helpful to every one. I have being reading your blogs since my Visa is refused. I only regret that why I wasn't aware of this website before applying for Visa.

I like to inform you that my Visa was refused in November and I have submitted my appeal against it and HO has accepted my appeal and called me for hearing on the 12th of March.

My visa was refuse on the following bases:

1. Current appointment of report was not submitted with my Visa application.

2. My 90 days Statement maintenance was not accepted

3. Contract was not submitted with my Visa Application.


Grounds of Appeal:

1. I have submitted my Current Appointment of report with my Appeal.

2. I have submitted my 90 days statement again. (I think HO missed one of the paper of Statement)

3. Without the permission to leave remain in I was unable to fulfil the obligation of the contract with the client.

Question:

I need your help and advice in the 3 point.

I am quite worried because it is in the Policy Guidance that Applicant have to submit the contract with application.
How I will defend this in front of the judge?
Will the judge accept my answer?
Can I Defend this in any other way?

Hi zohaib I have my hearing today going for it now so I do have the same point I hvent submit CAR with my case and all other details. But my lawyer is convincing me that they should have followed the evidence felxibility law. In my case they have followed it and I have sent them all of the documents they have required but they haven't asked me about CAR so I am going to fight for it they have done this intentionally. They are crooks.
I will suggest you take all the relevant documents with u and if required present it to the judge to clarify that it was available for you if it was missing UKba should have Asked you for it. I hope you will be fine. Don't trust lawyers they always says they have submitted but actually they have done the mistakes which we hve to pay off. Good luck to me and you

a company signs a contract with a client and then you are put forward to provide those service a contract is signed for, in this situation I do not see, you working for your company, needed a valid leave to remain neither is it a client concerned.

objections before above in relation to being unable to provide CAR with application may fall under flexibility policy and you said you supplied the evidence covering 90 consecutive days for the one of those objections I see defend able, while you need to strengthen your argument in view of your excuse as to why to have a valid leave to remain was or is necessary.
(your leave to remain stays valid until a negative out come of an appeal comes out anyway)

I believe you are right but in my case I have already mentioned in my grounds of appeal that client is not ready to do a contract until my leave to remain.
Please advice how can I defend this now or shall make a new contract with the client now and show it to judge during my hearing?

there must or may have been a reason made you make such a statement as valid leave to remain was needed for you to obtain a contract. if there was not any you got misled.
however your hearing is still far you can still involve in providing services according to your SOC.
you could also include this to your arguments that you did not know if having no passport or BRB in my possession I can deliver the services was a reason my contract was missing but ever since I knew that I can provide the services without those documents I am involved in providing services and proofs in shape of contract with who you would provide services to, should be there(bank transactions,invoices etc.).
furthermore a proof if you could get yourself one (could be letter from) a client who denied to accept your service objecting your visa or status at the 1st place has a potential to be considered a genuine excuse.
