Can i transfer my refugee application to uk from ireland

Can i transfer my refugee application to uk from ireland

Hi,

Am new to the board and would like to make some enquires.
Am a refugee applicant in ireland and still on my appeal stage .I got married to a british citizen last year , applied for residency based on marriage to an EU citizen but was refused on the ground that i have never lived lived in another eu country before coming to ireland.My question is that
Can i transfer my asylum application to uk based onthe fact that my husband is returning to uk.

-If that is possible , will i be able to change my status or do have to continue on the asylum ground over their in uk


OR
Is it better to stay in ireland and if not granted asylum , can i then go back to my country (nigeria) and apply from there

You should go home, forget asylum and apply for a spouse visa.

I don't the reason for refusal tho - it's ur husband's treaty rights that count - not urs since u do not have any rights to claim treaty rights.

Well if you're an asylum seeker, how/why would you want to go back to the country you're seeking asylum against? Wouldn't that be a (real) death trap for you?

And, why would you (want to) apply for asylum in Britain if you're married to a British Citizen. Why would you want to go through all the asylum application rather than a partner's visa?? I guess that's your question :roll: you can apply for a spousal visa.

Where is your partner based, UK or Ireland? And which country did you submit your residency permit?

i did submit my residency application in ireland but was refused since asylum seekers are bot regarded as legal and have not lived in another Eu country before coming to ireland My husband will be returning to uk since i was not granted residency in ireland and see if i can come to join him

Also i cant apply for a patner or spouse visa to uk from ireland cos am a n asylum seeker

So you applied for asylum and residency via EEA at the same time? Did you get married after your initial asylum refusal?

Anyway, like wanderer states, you can return home (safely?) and apply for a spouse visa there. If your husband was living in Ireland for work or study (not just visit), I think (but someone else can clarify), you might also be able to use the EEA route to live in the UK. But that's all I know about that. You should do a search on this board for EEA applications.
