Complicated Schengen Situation

Complicated Schengen Situation

Hi,

I'm posting to ask for advice...

I had been planning to travel to France later in the year with two friends, one of whom is a Dutch/New Zealand citizen, the other of whom is her husband, an Albanian with a five year EEA family member visa that expires next June (2008). Both are resident in the UK.

For family reasons, the woman has had to travel back to New Zealand, but expects the two of us to still travel to France. Her husband had not yet applied for his schengen visa. She plans to send her passport back so as he can apply.

Will it be a problem that he is not travelling with his wife, but with another woman, even with all the correct documentation, is the Dutch embassy likely to even consider his application and will the French border controllers have too many questions?

I assume that as he will not be travelling with his wife that Directive 2004/38/EC will be moot point.

I am a British Citizen and we could travel through separately, will this alleviate some of the difficulties?

If anyone has any ideas, please let us know.

No, he can travel to join his EU citizen partner.

I assume that as he will not be travelling with his wife that Directive 2004/38/EC will be moot point.
