spouse and step daughter citizenship different visa status

Post by wunit5times » Wed Jan 22, 2014 10:42 pm

hi all,

my wife has ILR and has now been here 3 years.
step daughter age 20 and step-son age 18 have same ILR and been here 3 years.

other step-daughter age 13 has 2 year visa, entered april 2012, visa expiry june 2014. (she joined late due to schooling hence the difference in time and visa status.

my question(s) is - firstly do 2 older 'kids' have to wait for 5 year residence requirement now that they are over 18? or can they also apply after the 3 years?

second part - when should the 13 yr old apply for citizenship? can she apply same time as mum, or do we have to wait until 3 year residency requirement met (therefore applying ILR first) or 5 year residency met?

many thanks
Tim

All unmarried adult naturalisation applicants have to wait for 5 year residence requirement now that they are over 18.

13 year old should get ILR first and spend at least two years in the UK.

thanks for the quick response!

The answer regarding the 2 older children is as expected. the answer regarding the younger child is disappointing. (not your fault of course) I did think once both parents, myself and mum have British passports she would be able to as well...alas nevermind.

without wishing to sound rude or unappreciative, but given this is the internet after all...may I ask, are you a lawyer, immigration officer etc ) i.e. someone with the knowledge to answer correctly. I just wish to be sure it's not someone making their 'best guess'. No offence intended please.
