UK absence

Post by sh14 » Sun Jan 26, 2014 11:51 pm

Hi
Please guide me in my case
I got HSMP in 2005 for 1 year intially and then got extension for 4 years in May 2006. I left UK in July 2006. I did not visit for 3 years and then in july 2009 I came for 3 weeks on the same visa. I went back and then came to UK in Dec 2009. Since then I am living in UK. I want to apply for ILR and I am very keen to apply in July this year. As if I count my period starting from july 2009, it will be 5 years this july. but there is a gap of 4 and half months (141) between july 2009 and dec 2009. Then again there is 21 days leave in 2010, which will be added to make it 162 days in total.
Do you think if I apply in july this year, will my application be accepted for ILR or not?
Thanks
Shahzad

Your abscences aren't a problem . You should get ILR provided you meet all other requirement.

I am on Tier 1 Migrants , I left uk for 21 days during job switching, would it effect my ILR? ( I am well below 180 days in 5 years period ).
