KOL requirements and delayed entry in UK - ILR

Hello,

I tried to find answers to my questions in this forum and UKBA but I could'nt. Can someone please direct me to the right place or answer few questions:

1) Me (main) and my wife (dependent) are applying for ILR and need to know what will suffice the English test requirements. I have been living in the UK on as tier 1 General applicant so can I assume that I fulfill the English test requirements? My degree is there in Ponit based (PBS) calculator.

2) My wife's degrees are also listed in the PBS calculator. Do they still need to be certified by NARIC?

3) I got my visa in July-2008 but I entered UK on in Feb-2009 - six months delayed entry. I will complete five years this February from the date I entered (feb-2009) . Is that fine? Or do I need to worry about six months delayed entry?

1) If you have already proved your English language requirements you don't need to prove it again.

2) Your wife needs "Statement of Comparability" from NARIC which should say that the degree is British bachelors equivalent. If the degree is lower than British Bachelors level then your wife needs to take an English test such as IELTS or ESOL. You also need a letter of medium of instruction from the university. So NARIC letter plus medium of instruction letter from university will make the home office happy. The link to NARIC is:

3) You don't need to worry. You'll be eligible for ILR in Feb 2014 if there are no breaks in your continuous 5 years.

Are there any online refernce which says that Tier 1 General do not need English Test if they have extended thier visa in this category before?

I will get my wife's degrees tested from NARIC.

Aren't these two different things - Degree equal to Bachelors degree of UK and Degree taught in English?

If 'Statement of Comparibilty' says that degree is equavalent to Bachelors in the UK does that mean it automatically fullfills the English requirements as well?

If that's the case, then my wife's degree is getting 30 points from PBS calculator which means its equavalent to Bachelors degree here.

Please clarify.

Yes. You need to get statement of comparability not English language assessment. The letter from university will be required as well that'll explain that degree was taught in English. This is explained by UKBA:
