Appeal Allowed and matter is remitted to the Respondent.

Post by alik28 » Wed Jan 29, 2014 6:16 pm

Hi,

I need expert advice. My appeal is allowed however judge wrote that matter is remitted to the Respondent for re-consideration. My application was refused because they couldn't verify my bank statement.

I don't have money available in that account but I have got money in different account. My question is will they verify my bank statement again and should I send them my other bank statement to inform money is in a different account.

I would really appreciate your comments.

Regards,

@ alik28, can you explain why you don't have funds in the previous account and also is the account in your name or third party sponsor.

Yes account was on my name and was in Pakistan. I kept money for 9 months but then we needed to use that money, however I have money in my UK personal account.

@ alik28, since both accounts are in your names, I think you should be fine. But you might need to find a credible answer should in case HO ask for updated statement for funds and you then present a UK bank account. So be ready if they ask when the fund got to UK and from where and they may ask why you didnt submit a UK bank statement from the onset which could have help their initial verification check.

Thanks,

Should I send them my bank statement before they ask or wait?.

If I don't send them my bank statement they can reject again by saying they were unable to verify again.

@ alik28, its very important to know why you didn't present your UK account from the onset, if you can prove that the funds have now been transferred to your UK account from your Pakistan account, then you can send them a new/updated bank statement to prove this. But if the account in Pakistan is no more active, then you should be very careful.

@ alik28, you will definitely get your visa as you have won the appeal, you just need to be prepare for HO as they might request additional documents.
