ILR for my Tier 1 general dependant

ILR for my Tier 1 general dependant

Hi Everyone,

I wonder if anyone can provide me with some advise.

I am currently on a Tier 1 general visa and my wife have been a dependant for the last 4 years. We will become eligible to apply for ILR on 23 April 2015. I am in a situation where I may not be able to apply for ILR this due to work commitments.

So my question is are my wife still able to apply for ILR on her own without me? Or does she need to switch to a different visa category?

Any help or advise will really be appreciated

No, she is ineligible to apply for ILR (319E) if you do not apply for yours (and also succeed). It's unlikely that she can remain in the UK.

Unless she qualifies under Long residence.

So there is also no alternative visa category she can switch too to enable her to qualify for ILR?
