Hello,
I had applied for my Tier-1 2nd extension and got the approval. The application was done for myself(main applicant) and for my Wife (as dependant). We have an infant daughter who is currently in India with grandparents. I got the approval letter on 27th Jan 2014 dated 22nd March 2014 but only received BRP card for the main applicant. Wife's BRP has not yet come. The application of my wife has been approved as I have received her approval letter along with mine. The approval letter says that you should be getting BRP within 10 working days from the date of this letter. The 10th working day will be 5th Feb 2014. I am sure that BRP has not been sent as I had emailed DX courier service asking for wife BRP and their reply came today as negative. So I'l have to chase the home office, no doubts in that. We have made travel plans to India on 21th March 2014 and will be returning on 12th April 2014 with our daughter. We thought we can get our Visa extended here and after that apply for daughter's extension from India. Now here are my questions:
Question 1:
Since only I have the BRP card with extension and wife has approval letter but yet no BRP and that we have already booked tickets to return on 12th April 2014. I was thinking to apply for daughter's extension right away. So would it be possible to apply for the child dependant visa with father's passport and BRP photocopies but mothers passport photocopy with approval letter(The letter has the home office reference number for the application). So here are the documents I have :
1. Father's passport and BRP photocopies
2. 12 months salary slips and bank statements to prove salary credits
3. Employer reference letter
4. 90 days maintenance funds for £4500 - Bank statements
5. Tenancy Agreement
6. Child's Passport .
6. Child's Birth Certificate
7. Our Marriage Certificate
8. Mother's Passport photocopy with husband's name endorsed and approval letter that her application for extension has been approved but no BRP photocopy as we haven't yet received wife's BRP card.
9. Mother's Employer Reference Letter.
Kindly let me know if these documents are enough or I do need Mother's BRP photocopies?
Question 2:
Since we parents are here in UK and the child is in India with grandparents, does this qualify as independent family unit? Please check the guidance http://ukba.homeoffice.gov.uk/siteconte ... olicy1.pdf (Page 18, point 110)
