Visa refused on fresh application Silly reason

Reason: Name not mentioned in Bank letter
I have bee been given right to re-submit Application and my team partner given appeal right. He logged appeal and I submit new application with all funds in my personal account.

Re-apply: July 2013
Interview: September 2013
Refused: 31st Jan 2014
Documents submitted: Personal bank account 50K. Business plan, Job description, Marketing material includes Calender, brochure, visiting card etc, Two contract, Business insurance, CAR, Accountant Letter, Facebook account, Twitter account, Company website, company ads on gumtree and yell etc etc.

Refusal reason:
The secratery of state not satisfied as to the genuineness of your application and in accordance with the paragraph 245DD(K) of the immigration rules, No points have been awarded in this area.

Now look at the refusal reason by Case worker: you stated that your all funds came from your family but you then stated that it then first went to your team member account. if your family had given you that money we expect to fund have been paid directly into your account and not into account of your team member...
My answer. Actually we applied together first and get refusal that time funds were in my team member father account as a 3rd party. Due to refusal i have moved these funds first to my team member account and then all funds i transferred to my personal account. So why i done this as we were not team member in new application due to same refusal reason but different right to exercise as i mentioned one get appeal right and i got re-submission.

I have to transferred this money into my partner account first as we don't have joint account. then one day later i transferred all funds into my account and submit fresh application. all funds were in my account since i applied and also show the bank statement in october 2013. funds still in my account but these idiot find something to refuse from nothing.

Can anyone guide me should i go for appeal or Re-submission
Can i appeal by self or through solicitor any suggestion.
is it ok if i loged appeal by self without wasting money to solicitor.

what i understand from yr refusal that yr friend's father transferred money to yr friend's acc and then all money was transferred to yr acc. if this is the case then i would say u r in trouble. the reason being, why yr friend's father will give u money when u r not in a joint application anymore? secondly if u claimed that yr family gave u money then how come yr friend's father gave u money? he is not yr family neither u showed him as a third party? i would say go for appeal and if i am right in understanding yr case then show in yr next application that yr friend's father gave u gift or make a relation of yr family with him saying that he was owing money to yr dad which he paid u as u needed money for application

@ Veedi0300, you stated that 50k funds belong to your team member's father and you both used the fund for your first application as team. Why will you now transfer the funds into your personal account to apply as sole applicant when your team member also need the same 50k fund for his evidence of funds even if he eventually win the appeal.

Your action was interpreted by caseworker as that of applicants who transfer money among themselves for the sole purpose of visa and not to do business.

You guys should have stay together as team member to use that same fund or you could have raise your own 50k funds seperately without linking your team member's father with your application since you are fully aware that he will also need the same 50k funds after winning his appeal.

You will find it very difficult to convince a judge of your genuineness as an entrepreneur.

In First application it was mentioned in Declaration and affidavit that funds will be available to both team member as we have family business relationship with applicant from ages.

Actually in first application they just refused us as our name was not mentioned on Bank letters as UKBA required. That bank letter mentioned that funds are transferable and disposable to UK.

I have just removed that objection by transferring these funds to UK. Funds were just came into my team members account just to clarify his position that he has also got the access to these funds then after one day these funds were transferred to my account. in first application we told them we both family has business relationship from ages.

We are still the directors of same business only problem was created by home office by giving one team member a right of appeal and other team member right to re-submit.

any good suggestion or advice from any Guru or expert or has similar experience as me. please guide me a good solicitor or Can I apply at my own.

No solicitor is good solicitor. all the want is your money and empty your pockets. Try your luck by appeal. or else logged appeal and then switch to new category as you already refused twice.
