When to apply for ILR

Dear All,
Below are my details :
1st entry clearance provided - 17/02/09 to 17/02/12
date of first entry to UK - 01/05/09
Extension applied and valid until 26/03/14
I am applying for ILR on 28/02/14 which is within 28 days of my current expiry date (26/03/14). Have i done this right? I will calculate my continuous period back from date of application i.e. 28/02/14. Is this the right way or do i need to calculate continuous period from the date i got my first entry clearance?

As long as you entered UK within 90 days of EC and completed five years. You should be ok.

You'll save some money too as ilr fee is going up in April.

Extension applied and valid until 30/04/14
I am planning to apply for ILR (1+3 dep) in person on 3 or 4/04/14 depeding on availability of the dates.which will be within 28 days of my current expiry date (30/04/14) and before 6 April when fee will increase. Since my Visa issue date was 22 Feb 2009 Can I calculate my continuous period back from that date of application? I really need to make it well before 6 April to avoid increased fee.

Yes you can apply.

But can I apply in end of March (21 to 30 March) that wouldn't be 28 days before 30 Apr 2014?

You can go for ilr any time after Saturday, 25 January 2014, the fifth anniversary of your first EC. Because you entered within 90 days of getting first entry clearance.

Hi All,


My initial Visa Date: 2nd June 2009
Returned to Home country: 8th Oct 2010
Back to UK: 17th July 2011
Due for second extension: 2nd June 2014 (So I would assume its 2 years extension ), So End date would be: 2nd June 2016

My concern would be 5 years continuous stay starts from 17th JULY 2011? Or can I apply for ILR on May 2016? Or need an another extention in 2016 for 1 month.
a) If caseworker counts from May 2016 to backward I would be less by 2 months which is within the 90Day continuous period. So can i apply in May 2016 ?
b) If caseworker counts from 17th JULY 2014 to forward I am not eligible for ILR.
As per the policies which one would case worker consider? and when i need to go for this year extension , Can go in March if 2016 require extension or in May if i can apply for ILR in 2016 with out extension
Your clarification would really help for my future planning.
