ILR -SET(0) spent more than 200 days outside uk in 5 years

I am currently working in UK on Tier-1 General visa. i have spent total of 214 days outside of united kingdom in 5 years.



Please find below the dates of my visas and also the date I first entered UK.

Tier 1 Entry Clearance issued : 03 February 2009
Entered UK: 11 April 2009
Tier-1 General Ext: 19 March 2012
Tier-1 Valid Until: 19 march 2014

i delayed entering united kingdom by 67 days after getting Entry Clearance and again i have spent 87 days outside of UK after my first entry. Total amount of 118 days outside of United kingdom in one year.

in 2013 went for holiday of 48 days.

Total of 214 days outside of united kingdom in 5 years

iAM APPLYING ON 05 FEB 2014 FOR ILR


I would be really thankful to you, if you could please confirm that, I am eligible to apply for ILR , as i have spent 118 days outside of united kingdom continuously in one year and a total of 214 days outside of united kingdom in 5 years.

yes, u can apply as the number of days outside UK is less than 180 days. for further reading, plz refer to UKBA website regarding new rules for ILR which is valid from 28th august 2013.

You should be fine since you did not exceed 180 days in a given year.
