If tier 1 application refused?

Post by ashan » Sun Feb 09, 2014 1:51 pm

Hi all,
Can anyone please help me with this as its urgent :(
I applied for tier 1 (entrepreneur visa) last year feb 14 but its been refused and the reason was "they saying i don't have include my name on the advertisements I've published :( ) so i appealed against that decision and i won the first appeal then they appeal against that decision and i lost in the higher tribute :( i just got the letter on friday but they have mentioned that i can appeal again but i don't think it will worth so im thinking of applying for student visa. I want to know is it possible to do that? Because in that letter they don't mention anything about it,
Please help me with this

if you want a honest word you should apply for the same visa again but if you want an opinion on applying under Tier 4 student it may and would create problems for you, all most all sorts of visa application are now put through genuine test as getting CAS now will clearly indicate you not being genuine but the one who only wants to remain in the UK.
you might get lucky if you are already studying and going towards completion seems unlikely in your case as most of us wake up late, or provided if there are some exceptional circumstances compelling you for studying.

the case you lost at upper tribunal seems to have potential in it considering the requirements that you met except the ones caused dismissal you should be okay with re-applying if can over come the faults found last time.
thanks,

Thank you,
The problem i cant re apply the same category is i got the money from my relations and so on and its been held in my account for so long so i had to give some of them back , but im thinking as ive already finished my degree if i do my masters and then apply i might have a good chance,

But the letter i got from the court doesnt say anything about switching visa , so wondering if i could get a CAS and apply do you believe still there will be a chance that it get refused ?
Thanks

I'm sure my previous post explains it all and is based up on my own understanding. you might get more authentic advice if you consulted the professionals such as lawyers, that you should go for.
thanks,
