Fresh Application

Hello Everyone,

I made a Tier 1 entrepreneur application in Dec 2012, the application was declined. I went to the appeal hearing in January 2014. I am currently appealing to the Upper Tribunal for permission to appeal. But I have been advised to make a fresh application which am currently preparing now.

Am making the current application as a team with 50K. I want to ask the following questions since am making the fresh application as an entrepreneur team;

1) Do we have to submit our applications at the same day?

2) How do I inform UKBA that my international passport and other documents are in the first failed application? Should I write a letter explaining this?

3) Do I withdrawn my appeal before I submit my fresh application or after UKBA have send there letter of confirmation - confirming they have received my fresh application?

4) Assuming my direct application to the Upper Tribunal is unsuccessful, how many days do I have to submit my fresh application. Am only asking because I have heard that they make there decision pretty quick and all my documents for the fresh application will be ready at the end of February 2014.

I will really appreciate your reply. And I want to say thanks in advance.

answers to your questions chronologically as follows:
1) you do not have to submit application on the same day but u must submit within 28 days after the appeal right exhaustion, but my suggestion that submit on the same day in the same envelop if possible
2) in the application form there is a section for letting the case worker know that yr passport is in the home office but u can write that in a covering letter as well
3)u must withdraw yr appeal before the application otherwise yr application is invalid
4)after yr appeal right fully exhausted or withdrawal of appeal u must make the fresh application within 28 days(which includes weekends and holidays as well)

@tanvir1985th thanks for your reply. If we submit our applications on the same day putting them both in the same envelop like you advice, do we put two business plan, two market research, two bank statements and two current appointments report in the envelop or is one each of these documents enough?

Must be 2 of everything and 2 packages and put both packages in one big envelop

@ benjamin2000, your applications should be in separate envelope for you and your team member because they are different application regardless of you being team members, you should only include your dependant applications in your own envelope.

@Olasunkanmi Thanks. The other just informed me that his current visa is student visa. I was making all the preparations thinking he got PSW. Student visa doesn't work with 50K. Now the business plan has to be rewritten. Thanks for your advice.
