ILR form for Dependent child age more than 18

Post by sanjeev211161 » Sat Mar 01, 2014 11:29 pm

Hi
I am on Tier 1 (General) along with my family consisting wife and two children who have now crossed 18 years of age. Although I got Tier 1 in August 2008 but for some reasons I came on 19 March 2009 and kids came on 13 June 2009. As per these dates I am planning to apply for ILR along with my kids as they will be covering 5 years qualifying period on 13 June 2014. Kindly advise me on the following:

1. SET(O) form can be used to include my wife along with me but children will have to apply separately using the same form SET(O) because they are over 18 years of age. I have gone through the form but 6.1 of SECTION 6- IMMIGRATION HISTORY is a bit confusing as it is asking about the first entry date of the MAIN APPLICANT rather than asking for the child who is applying separately.
2. Can I apply 28 days before 13 June 2014 i.e any day after 19 May 2014
3. The new home page of UKBA is quite confusing which i had accessed on 01/03/2014

Kindly advise me
Regards
Sanjeev

The key is that the child aged 18+ is not living an independent life. There is no 5 year qualifying period for children, they apply when you're eligible for SET(O).

Hi Amber
Thanks for your reply,
In fact my children are stuck up at 6.1 of SECTION 6 of SET(O) as it is asking the first entry date of main applicant rather than asking for my child's first entry. Further the next question i.e 6.2 is asking the details of absences of my child. So how they are able to find the total number of absences when the first entry date of my child is not asked in the form any where,
Cheers
Sanjeev

If one is applying for SET(O) on their own, they are the main applicant.
